AMPHIBIAN FINS - LIMITED LIFETIME WARRANTY, LIMITATION OF REMEDIES:

(a) Except as otherwise specified herein, Omega Aquatics, Inc. (Omega) warrants its Amphibian Dynamic Scuba Fins to be free from defects in material and workmanship and to perform in the manner and under the conditions as specified by Omega for the life of the product.

(b) This warranty does not cover any damage to such consumable items as fin straps and buckles included with purchase. This warranty does not cover discoloration of materials or surface degradation or wear from normal use.

BUOYANCY COMPENSATORS - LIMITED WARRANTY, LIMITATION OF REMEDIES

(a) Except as otherwise specified herein, Omega warrants its Buoyancy Compensator Devices (BCDs) to be free from defects in material and workmanship and to perform in the manner and under the conditions as specified by Omega for three (3) years from the date of original purchase. Annual service by an authorized Omega dealer is required.

(b) This warranty does not cover discoloration of materials, cuts or tears, abrasions, punctures or seam separation caused by chemical exposure--including prolonged chlorine exposure.

GENERAL PROVISIONS (a) This warranty is the only warranty made by Omega with respect to the Products and no representative or person is authorized to bind Omega for any obligations or liabilities beyond the warranty in connection with the sale of Omega's goods.

(b) In the unlikely event of a warranty claim, these remedies are available when Omega is notified by an authorized dealer promptly upon discovery of the defect, and Omega's examination of such goods discloses to Omega's satisfaction that such defects actually exist and the goods have not been: (i) repaired, worked on, or altered by persons not authorized by Omega so as, in Omega's sole judgment, to injure the stability reliability, or proper operation of such goods; (ii) subject to misuse, negligence or accident; or (iii) connected, installed, used or adjusted otherwise that in not accordance with the instructions furnished by Omega.

(c) If an authorized Omega dealer is not located within a reasonable distance from Customer's location, Customer will return defective Products to Omega offices as designated by Omega customer service representative, costs prepaid and borne by Omega.

(d) Where a warranty condition exists, the Omega authorized dealer will replace the parts found to be defective under this warranty. If Omega is working directly with Customer to resolve the warranty issue, Omega will promptly replace the parts found to be defective under this warranty within a reasonable time frame.

(e) If it is found that any Product has been returned without cause and is still serviceable, or falls into any exclusion listed in Paragraph (c) above, replacement or repair will be made only at the determination of Omega officials. In th event warranty repair or replacement is denied by Omega, Customer will be contacted to arrange for possible remedies or replacement costs involved.

(f) THE FOREGOING WARRANTY SHALL BE THE CUSTOMER'S SOLE REMEDY AND OMEGA'S SOLE LIABILITY ON CONTRACT OR WARRANTY FOR THE PRODUCT.

Some states in the U.S. and some foreign countries do not allow limitations on the duration of implied warranties, so this may not apply to you. This warranty gives you specific legal rights. You may have rights which will vary from state to state and country to country. OMEGA AQUATICS DISCLAIMS AND EXCLUDES ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME STATES IN THE U.S. AND SOME FOREIGN COUNTRIES, DO NOT ALLOW EXCLUSIONS OF LIABILITY, SO THIS MAY NOT APPLY TO YOU.
